Practice AreasAt Gregory Kudela & Associates, P.C., we represent individuals and businesses in a wide variety of civil and criminal matters, from divorce and criminal law through business disputes. Please take a look at our practice area pages to learn more about each area of the law and about what we can do for you. Family Law/Divorce Family law issues are never easy. Divorce is hard not only on the parties involved, but on any children in the family as well. We work hard to make sure that the negative impact on the children is minimized, by working with the parents to achieve a mutually beneficial result. We will try to make battles over custody and visitation rights as amicable as possible. If a fight is necessary, we try to keep the children out of it if at all possible. We will also assist with such issues as property settlements, alimony, child support, and modifications to these support agreements. We also handle a variety of other family law issues, including paternity disputes and paternity testing, adoption, and stepchild adoption. If you are dealing with a divorce or other family law issue in Michigan, please do not hesitate to call us at Gregory Kudela & Associates, P.C. today. Our firm is very experienced in defending individuals against all types of driving offenses. This includes everything from minor traffic offenses to driving while intoxicated (DWI). We handle misdemeanors, gross misdemeanors, and felonies. Some of the offenses we have represented clients against are reckless driving, speeding, driving without insurance, and DWI. Since DWI can be a felony, depending on the circumstances, it is important to have legal representation. Often, your chances of leaving the district court without receiving jail time are greatly improved simply by having a lawyer on your side. We also specialize in representing clients before the Michigan Secretary of State Driver License Appeals Division. You may have to appear before this court if your drivers’ license has been revoked or suspended. After a specified period of time, you can petition this court to get your license back. Once again, individuals with representation tend to fare much better in court than individuals who appear pro se (without a lawyer). We represent clients in all types of commercial and residential real estate transactions and disputes. We can assist you in drafting real estate purchase and sale agreements or represent you in court when the agreement is broken. If you are dealing with a zoning issue, we can represent you before the local municipality to appeal zoning decisions or ask for a variance, or to have plans for a development approved. We also practice municipal real estate law, in the areas of land use and city/community planning. Sometimes, issues arise during construction of a building. There may be an issue with a party not being paid, such as a plumber or electrician. These individuals can put a mechanic’s lien on the building, which means that if the building is sold, they will receive the money they were owed for their services out of the sale price. Sometimes, contractors will fight about when or whether they will get paid for certain work, or about which subcontractor is entitled to do the job. If you are dealing with a real estate dispute, such as a mechanic’s lien, or a contractor dispute, we have experience representing clients on both sides of these matters. Wills, Trusts, Estates, & Probate It is very important to have a plan for your estate, especially if you have children or other dependents. We can assist you with all of your estate planning needs. We have a significant amount of experience in drafting wills and setting up trusts, both for large and for small estates. With your estate plan, we can help identify whether taxation will be an issue, and do advanced tax planning to minimize your liability as much as possible. If your estate is considered “non-taxable,” we can assist in planning your estate so that the minimum number of assets ends up in probate. Probate is a process where the court takes certain parts of your estate, inventories it, and then directs it on to the people it is supposed to go to. There are many ways to avoid probate, such as life estates and trusts. If your estate does need to go to probate, we have experience representing clients in all types of matters involved with this, including guardianships, conservatorships, and contested probate estates or decedents estates. We can handle any probate matters, from the simplest to the most complex. We can also assist you in preparing powers of attorney and advance directives, in the event you are incapacitated and unable to make your own financial and health care decisions. If you need assistance in planning your estate in any way, please do not hesitate to contact us today. We can represent your business in all its needs, from formation through dissolution and everything in between. We will help you choose a business type (partnership, corporation, or LLC) that fits your needs, and then assist you in filling out and filing the required paperwork. We represent local companies (stores, retailers, manufacturers of auto parts, auto suppliers, and other manufacturers) with questions about employment law. In your dealings with other businesses, we will look over contracts made with vendors and suppliers, or represent you in the purchase or sale of a business. In addition, we specialize in all types of franchising issues, including the various state requirements. In Michigan, you are required to register with the state, write up information about your company, and give the state financial information in order to sell stock to people outside the company. In addition, if you are thinking of buying a franchise, you should be aware that you are entitled to see this information about the company and that you have the right to read this information before you spend any money. If you are looking to sell a franchise, we can help you arrange information on suppliers, specifications, and other information in a way that complies with Michigan requirements. We can assist not only in transactional matters, but in business litigation matters as well. However, we recognize that, while a lawsuit may seem like the only option at the time, it often is not the best idea. Business relationships are often better served through a negotiated settlement or other non-suit solution. If you need legal assistance with any of your business needs, please do not hesitate to call us today! Being charged with a criminal offense is often frightening, even if it is not the first time you have had to deal with the criminal justice system. You may not know anything about the law in the area, or about the procedures at the district court. We will explain the law to you, as well as the procedure we must go through to handle your case. Our criminal law practice is small but growing. Currently, we handle misdemeanors and smaller felonies within our organization. This includes such offenses as theft, burglary, assault, narcotics cases, sex crimes, and many other offenses. We work closely with another lawyer in our building who handles more serious offenses such as rape and homicide. We also handle driving offenses; please see that area of our practice pages for more information on our representation in this area. Gregory Kudela & Associates, P.C. | ||||||
